Some states do not allow limitations on implied warranties or exclusions of certain damages, so the above limitations may not apply to you in full. 13. Dispute Resolution

13.1 Informal Resolution

The parties agree to attempt in good faith to resolve the dispute informally within thirty (30) days of the notice being received. If the dispute cannot be resolved informally within this period, either party may proceed with formal dispute resolution as described below.

13.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS. EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED BELOW, YOU AND PUNCH PIZZA AGREE THAT ALL DISPUTES, CONTROVERSIES, OR CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE OR SERVICES SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, RATHER THAN IN COURT.

Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration provider. The arbitration shall take place in the United States, and the arbitrator's decision shall be final and binding. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this arbitration provision.

13.3 Class Action Waiver

YOU AND PUNCH PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Punch Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

13.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may bring claims in small claims court if the claims qualify. Either party may also seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.

14. Term and Termination

These Terms shall remain in full force and effect while you use the Website or Services. Punch Pizza reserves the right, at its sole discretion and without prior notice or liability, to:

  • Suspend or terminate your access to all or any part of the Website or Services for any reason, including but not limited to a breach of these Terms;
  • Delete your account and all associated data in accordance with our Privacy Policy;
